1. Agreement to Terms

By accessing or using Dump3 ("the Service"), operated by AD2Place Digital SL ("we," "us," or "the Company"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of the Service

Dump3 is a web-based productivity application designed to help users, particularly those with ADHD, organize their thoughts and prioritize tasks. The Service includes:

• A text input ("brain dump") where users can write unstructured thoughts.
• AI-powered task extraction and prioritization using the Claude API by Anthropic.
• A visual timer with color-based time tracking.
• Task completion tracking with motivational feedback.

3. Not Medical Advice

Dump3 is a productivity tool, not a medical product. It does not provide medical advice, diagnosis, or treatment for ADHD or any other condition. The AI-generated task suggestions are convenience features, not clinical recommendations. Always consult a qualified healthcare professional for medical guidance.

4. Accounts

4.1 Anonymous Use

You may use certain features of Dump3 without creating an account. An anonymous session is created automatically on your first visit. Data from anonymous sessions is stored on our servers but is not associated with any personally identifiable information.

4.2 Registered Accounts

To access all features, sync across devices, or subscribe to a paid plan, you must create an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4.3 Account Deletion

You may delete your account at any time from Settings > Delete my account. Deletion is immediate and permanent. All your data (brain dumps, tasks, summaries) will be destroyed. Active subscriptions will be cancelled automatically.

5. Plans and Pricing

5.1 Free Plan

The free plan provides access to the core functionality of Dump3 with certain limitations, including a maximum of 1 brain dump per day, 7 days of history, and limited ambient sounds.

5.2 Pro Plan

The Pro plan is available as a monthly subscription ($5/month) or as a one-time Lifetime purchase ($79). Pro features include 10 brain dumps per day, voice input, full history, all ambient sounds, and visual themes.

5.3 Pricing Changes

We may adjust pricing in the future. Existing subscribers will be notified at least 30 days before any price increase takes effect. Active subscriptions will continue at the original price until the end of the current billing period.

6. Payments and Billing

All payments are processed by Lemon Squeezy LLC, which acts as our Merchant of Record. Lemon Squeezy handles billing, invoicing, sales tax/VAT collection, and refunds on our behalf.

• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You can cancel your subscription at any time from the app or from the Lemon Squeezy customer portal. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.
• Refunds are handled according to Lemon Squeezy's refund policy. For refund requests, contact us at dump3app@gmail.com.
• The lifetime plan is a one-time payment that grants permanent access to Pro features for as long as the Service operates.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable laws.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use automated scripts, bots, or other tools to excessively access the AI features or circumvent rate limits.
• Submit content through brain dumps that is harmful, threatening, abusive, or that constitutes illegal activity.
• Attempt to access other users' data or interfere with the Service's infrastructure.
• Resell, redistribute, or sublicense access to the Service without our written permission.

We reserve the right to suspend or terminate accounts that violate these terms.

8. AI-Generated Content

Task suggestions, prioritization, and encouragement messages generated by the AI are provided "as is" without any guarantee of accuracy, completeness, or suitability. The AI may occasionally produce unexpected, irrelevant, or incorrect suggestions.

You are solely responsible for deciding which tasks to pursue and how to manage your time. Dump3 and AD2Place Digital SL accept no liability for any consequences arising from following or not following AI-generated suggestions.

9. Intellectual Property

The Dump3 application, including its design, code, features, and brand, is the intellectual property of AD2Place Digital SL.

You retain ownership of the content you submit (brain dump text). By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service (including sending it to the AI for task extraction).

10. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

If the AI service (Claude by Anthropic) is temporarily unavailable, Dump3 provides a fallback mode where you can manually select your tasks.

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time. If we discontinue the Service entirely, we will provide at least 30 days' notice and allow you to export your data.

11. Limitation of Liability

To the maximum extent permitted by applicable law, AD2Place Digital SL and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100, whichever is greater.

This limitation does not apply where prohibited by law, including mandatory consumer protection provisions of the European Union.

12. EU Consumer Rights

If you are a consumer in the European Union, you have a 14-day right of withdrawal for digital purchases. However, by using the Service immediately after purchase (including starting the Pro features), you acknowledge that you waive the right of withdrawal for that billing period, as permitted under EU Directive 2011/83/EU.

Nothing in these Terms limits your statutory rights as an EU consumer.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Spain. Any disputes shall be submitted to the courts of Barcelona, Spain, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
